These General Sales Conditions govern the offer and sale of products and/or services through the sales section of the site www.morphica.eu (respectively, in the "Shop" section of the website www.morphica.eu).

On e-Commerce (hereinafter referred to as the "Shop", MORPHICA SRL offers for sale, (company with registered office in viaEugenio Montale n. 3, Monopoli (BA), CF / VAT number 07949220722 and BA Business Register, cap. Soc. EURO 10.000,00, REA BA - 593400) Shining 3D, Eumakers, Roboze, Computer Art, Zortrax, Emotion Tech, Prima 3D, Anycubic, Creality 3D brand products.

MORPHICA s.r.l. is the owner of the Website and the Shop, as well as the related domain names.

The products sold on the Shop ("Products and Services") are offered and sold by MORPHICA s.r.l., with registered office in via Eugenio Montale n. 3, Monopoli (BA) - Italy, registered in the Bari Companies Register under no. 593400, VAT number 07949220722 ("MORPHICA").

1. Area of application and Webite browsing

1.1 The offer and sale of the Products and / or Services on the Shop constitute a distance contract governed by Chapter I, Title III (articles 45 et seq.) of the Decreto Legislativo 6 September 2005, n. 206 ("Codice del Consumo") and by Decreto Legislativo 9 April 2003, n. 70, containing the regulation of electronic commerce.

1.2 These General Sales Conditions are applied to all sales made by MORPHICA S.R.L. on the Shop.

1.3 The General Sales Conditions can be changed at any time. Any changes and / or new conditions will be effective from the time they are published on the shop.morphica.eu website, in the "Legal terms and regulations" section. Users are, therefore, invited to regularly access the Website and to consult, before making any purchase, the most updated version of the General Conditions of Sale.

1.4 The applicable General Sales Conditions are those in force on the date of dispatch of the purchase order.

1.5 These General Sales Conditions do not regulate the sale of products and / or the provision of services by parties other than MORPHICA that are present on the Shop through links, banners or other hypertext links. Before making commercial transactions with these parties, it is necessary to verify their sales conditions. MORPHICA is not responsible for the provision of services and / or the sale of products by these parties. MORPHICA does not carry out any control and / or monitoring on the websites that can be consulted through these links. MORPHICA is therefore not responsible for the contents of these websites nor for any errors and / or omissions and / or violations of the law by the same.

1.6 The user is required to carefully read these Legal Terms and Regulations, that MORPHICA makes available in the "footer" of the Shop, and that may be to stored and reproduced, as well as all the other information that MORPHICA provides on the Website and / or on the Shop, both before and during the purchase procedure.

1.7 These General Sales Conditions are applicable in the following States: WORLD.

1.8 The Website allows each user to browse and, after registering, to make purchases on the relevant Shop in each Country, regardless of the State in which the user is physically located when accessing the Shop.

2. Purchases on the Store

2.1 The purchase of Products on the Shop is allowed only to persons who:

  1. they are 18 years old;

  2. they are consumers;

  3. are registered on the Site, as required by art. 3 below.

2.2 The user is allowed to purchase more Products with the same order ("Multiple Order");

2.3 In the case of orders from anyone coming, which are abnormal in relation to the quantity of the products purchased or the frequency and / or mode of the purchases made, MORPHICA reserves the right to undertake all the actions necessary to stop the irregularities, including the suspension of access to the Website and/or the Store, cancellation of registration or non-acceptance or cancellation of irregular orders.

2.1 MORPHICA reserves the right to refuse or cancel orders originating from:

i. a user with whom it has an ongoing legal dispute;

ii. a user who has previously violated the conditions and / or terms of the purchase agreement with MORPHICA;

iii. a user who has been involved in fraud of any kind and, in particular, in fraud related to credit card payments;

iv. users who have issued false, incomplete or otherwise inaccurate identification data or who have not sent MORPHICA promptly the information and / or documents requested within the following procedure under Article 9.7 or having sent invalid documents.

3. Registration on the WebSite

3.1 The purchase of the Products on the Shop can take place only after registration on the Site.

3.2 Registration on the WebSite is free. To register on the Site, the user must complete the appropriate form, entering the name, surname, company, VAT number or tax code, e-mail, telephone number, billing address, in the case of an Italian company PEC and/or destination code, a password and username by clicking on "Register". The registration on the WebSite will be confirmed to the user by a specific e-mail.

3.3 The country in which the user is browsing when registering on the WebSite is the Country of Registration. The country of registration cannot be changed. Each user can only use one registration.

Registration on the Site, by opening a personal account, allows the user to:

i. Save the addresses;

ii. Access all order information;

iii. Follow the order status;

iv.Manage your personal data and update them at any time.

3.4 The registration credentials (username and password) allow the user to make purchases on the Shop. In any case, the registration credentials must be kept with extreme care and attention, can only be used by the user and cannot be transferred to third parties. The user undertakes to keep them secret and to ensure that no third party has access to them. The user also undertakes to immediately inform MORPHICA if the users suspects or becomes aware of any improper use or disclosure of the same.

3.5 The user guarantees that the personal information provided during the WebSite registration process is complete and truthful and undertakes to keep MORPHICA harmless from any damage, compensation obligation and / or sanction arising from and / or in any way connected to the violation by the user of the rules on registration on the WebSite or on the preservation of registration credentials.

3.6 Registration on the WebSite constitutes acceptance of these General Sales Conditions.

4. Information directed to the conclusion of the contract

4.1 In compliance with the Decreto Legislativo 9 April 2003, n. 70 laying down provisions on electronic commerce, MORPHICA informs the user that:

i. the contract is concluded when the user makes the payment;

ii. once payment has been made at the end of the purchase process and received confirmation of the validity of the payment method used, except as provided by art. 9.3 and subsequent sub-paragraphs, MORPHICA will send to the user the e-mail address indicated the confirmation of the purchase, delivery costs and any additional costs as well as information on the right of withdrawal or its exclusion;

iii. the order form will be stored in the MORPHICA database for the time necessary for the execution of the same and, in any case, according to the law. To access your order, the user can consult the appropriate section - "My orders" of the Shop.

4.2 The languages available to users for the conclusion of the contract are Italian, English. Customer Service is able to communicate with users in the same languages.

5. Product Availability

5.1 The Products offered on the Shop are items for Additive Manufacturing (such as, for example, 3D printers, 3D printer spare parts (printing plates, nozzles, covers, filters, extruders, etc.), 3D scanners, material of consumption for 3D printing (filaments, resins, pellets, etc.), useful products for the post-processing of pieces made with 3D printers present in the electronic catalogue published on the Shop at the time of the order by the user.

5.2 Product availability is continuously monitored and updated. However, since the Shop can be visited by several users at the same time, it could happen that several users buy the same Product at the same time. In such cases, therefore, the Product for a short period of time could be available, while it is instead exhausted or not immediately available, since it is necessary to wait for the replenishment.

5.3 If the Product is unavailable for the reasons indicated above or in other cases of unexpected unavailability of the Product, without prejudice to the other rights attributed to the user by the law and, in particular, by the Capo XIV of the Titolo II of the Libro IV of the Codice Civile, MORPHICA will immediately notify the user by e-mail. The user will then be entitled to terminate the contract immediately, except for the right to compensation for damages, pursuant to and for the purposes of the provisions of the art. 61, IV and V comma, of the Codice del Consumo.

Alternatively, and without prejudice to this right, the user may accept one of the following MORPHICA proposals:

i. if a restocking of the Product is possible: a delay in delivery terms, with indication by MORPHICA of the new delivery term for the restocked Product;

ii. if a restocking of the Product is not possible: the supply of a different product of equivalent or greater value, prior difference payment and acceptance by the user. It should be noted that, if the user has chosen to pay the initial purchase with Real Time Banking Mode (where available), and, in the here regulated hypothesis, if the user has chosen to obtain the supply of a Product of a value greater than the initially indicated Product value, it will be necessary to proceed with the termination of the contract (and the consequent cancellation of the initial order, with corresponding repayment of the Total Amount Due according to the provisions of Article 5.4 below), and, therefore, to the provision of a new order concerning the greater value product.

The user's choice must be promptly communicated to MORPHICA, by e-mail, to the address indicated in art. 16 below.

5.4 In the event that the user makes use of the resolution right pursuant to art. 61, IV and V comma, of the Codice del Consumo, and if the payment of the total due amount - consisting of the price of the Product, delivery costs, if applied, and any other additional costs, as resulting from the order (" Total Due Amount ") - has already occurred, MORPHICA will refund the Total Due Amount without undue delay and, in any case, within the term of 15 working days from the dispatch of the order. The refund amount will be communicated to the user via e-mail and credited to the same payment method used by the user for the purchase. In the case of payment by bank transfer, MORPHICA will ask the user for the bank details necessary for the repayment. Any delay in crediting may depend on the bank, the type of credit card or the payment solution used. In any case, the value date of the refund will be the same of the payment.

5.5 In the case of a Multiple Order, if the supervening unavailability concerns only some of the Products included in the Multiple Order - without prejudice to the rights attributed to the user by the law, and, in particular, by the Capo XIV of the Titolo II of the Libro IV of the Codice Civile, and without prejudice to the application of the articles 5.3 and 5.4 that precede, if the unexpected unavailability concerns all the Products object of the order - MORPHICA will immediately notify the user by e-mail. The user will therefore be entitled to immediately terminate the contract, limited to the Product and / or Products that have become unavailable, except for the right to compensation for damages, pursuant to and for the purposes of the provisions of art. 61, IV and V comma, of the Codice del Consumo. Alternatively, and without prejudice to this right, the user can accept one of the following MORPHICA proposals:

i. if a restocking of the Product and / or the Products included in the Multiple Order which have become unavailable is possible: a delay in the delivery terms for these Products, indicating the new delivery term for restocked Products;

ii. if a restocking of the Product and/or the Products included in the Multiple Order which have become unavailable is not possible: the supply of different products of equivalent or greater value, prior difference payment and acceptance by the user. It should be noted that, if the user has chosen to pay the initial purchase with Real Time Banking Mode (where available), and, in the here regulated hypothesis, if the user has chosen to obtain the supply of a Product of a value greater than the initially indicated value of the Product, part of the Multiple Order, it will be necessary to proceed to the partial termination of the contract (and the consequent cancellation of the initial order, with corresponding repayment of the Total Amount Due according to the provisions of Article 5.6 below), and, therefore, to the provision of a new order concerning the greater value product.

The user's choice must be promptly communicated to MORPHICA by e-mail, to the address indicated in art. 16 below.

5.6 In the event that the user makes use of the right of resolution pursuant to art. 61, IV and V comma, Codice del Consumo, the purchase contract of the Product (s) included in the Multiple Order which has / have become unavailable will be partially terminated, limited to this / these Product (s), with the consequent return, if the amount due in relation to these Products and any other possible additional costs due in specific relation to these Products ("Partial Due Amount ") has already been paid. The resolution of the entire Multiple Order will be possible only in the case of evident and proven accessorial of the Product (s) included in the Multiple Order which have become unavailable compared to the other Products available in the Multiple Order available. The Partial Due Amount to the user in relation to the Product (s) which has / have become unavailable, will be refunded without undue delay and, in any case, within 15 working days from the dispatch of the order. The refund amount will be communicated to the user via e-mail and credited to the same payment method used by the user for the purchase. In the case of payment by bank transfer, MORPHICA will ask the user for the bank details necessary for the repayment. Any delay in crediting may depend on the bank, the type of credit card or the payment solution used. In any case, the value date of the refund will be the same of the payment.

Custom Made Products

MORPHICA reserves the right to offer and/or sell to the user, at the request thereof, the possibility to purchase Products so-called "Custom made", i.e. products that, starting from a basic model, the user can choose to customize.

Unless otherwise specified in the Product Sheet and / or during the purchase process, the customized Products will then be delivered no later than 3 - 6 weeks from the dispatch of the relative order and possible acceptance of MORPHICA. If the customized Product is not produced or in cases of failed or delayed delivery, the provisions of art. 10.12 below will be applied. All other provisions of these Term, as far as compatible, are also applied. In any case, the user is reminded that, in relation to the customized Product, both the right to replace the product (see article 8.3 below) and the right of withdrawal (see article 11 below) are excluded.

6. Product Information

Each Product is accompanied by an information sheet that illustrates the main features and, in the case of customized Products, the customization options available to the user ("Product Sheet"). The images and descriptions on the Shop reproduce the characteristics of the Products as faithfully as possible. The colours of the Products, however, may differ from the real ones due to the settings of the computer systems or the computers used by the users for their viewing. Furthermore, the images of the Product on the Product Sheet may differ in size or in relation to any accessory products. These images must therefore be understood as indicative and with tolerances of use. For the purposes of the purchase contract, the description of the Product contained in the technical data sheet will prevail.

7. Prices

7.1 All the prices of the Products published on the Shop are expressed in euros and do not include the Value Added Tax - VAT.

7.2 Users are informed that, due to various factors, including the commercial policy of the trademark owners, the price of the Products offered for sale on the Shop may be different for different countries.

7.3 MORPHICA reserves the right to change the price of the Products, at any time, without notice, provided that the price charged to the user will be the one indicated on the Shop at the time the order is made and that no variations (up or down) will be considered after the transmission thereof.

8. Purchase orders

8.1 The Products will remain the property of MORPHICA until payment by the user of the Total Due Amount. If the Total Due Amount is not paid, or the successful outcome of the payment is not confirmed, the purchase contract will be considered terminated by law pursuant to and for the purposes of art. 1456 of the Codice Civile, except as provided for art. 9.3. The user will be notified by e-mail of the termination of the contract and the consequent cancellation of the order.

8.2 MORPHICA will ship the Products only after receiving confirmation of the successful payment of the Total Due Amount by the user. The risk of loss or damage of the Products for reasons not attributable to MORPHICA, on the other hand, will be transferred to the user, when the latter, or a third party designated by the user and different from the courier service, will materially takes possession of the Products.

8.3 If after the purchase of a Product and its receipt by the user, the latter wishes to replace it - without prejudice to the user rights under the law, and, in particular, pursuant to articles 11, 12 and 13 of these Conditions – the replacement will be possible only within 14 days from the date on which the purchased Product was delivered to the user, and when the following conditions are met: (i) the returned Product is intact and complete of any accessories, labels, leaflets and inserted in its original packaging, with a copy of the purchase invoice and the completed in its entirety exchange form provided for in the following paragraph, and (ii) the Product requested by the user replacing the one purchased is available from MORPHICA.

To carry out the replacement referred to in the preceding paragraph, the user must follow the procedure described in the document containing the exchange form and the relative replacement instructions, as inserted in the package containing the Product purchased by the user; this procedure can also be consulted in the "Customer Assistance" section of the Shop.

If the replacement procedure pursuant to this art. 8.3 is verified that has been correctly followed by the user, MORPHICA will:

i. without undue delay, and in any case within 3 working days from the moment in which the package containing the returned Product is received, credit the User with the Total Due Amount (excluding delivery costs, if applied, and any other possible additional cost, as resulting from the order) paid by the user in relation to the returned Product. The re-credit will be made on the same payment method used for the initial purchase and an e-mail confirming the repayment will be sent to the user;

ii. when the requested Product as a replacement is sent by MORPHICA to the user, charge the latter the price of that Product (regardless of whether it is equal, lower or higher than that of the initially purchased Product) on the same payment method used for the initial purchase. At the time of shipment, a shipping confirmation e-mail will also be sent to the user;

iii. upon receipt of the package containing the Product that the user wishes to replace, deliver to the user the Product chosen in replacement, within the terms of delivery and with the effective date indicated in the instructions referred to in art. 8.3, second paragraph above.

It should be noted that if the user has paid with Real Time Banking Mode (where available) and then wishes to proceed with the replacement of the initial Product with one of higher economic value, it will be necessary to proceed with the termination of the contract relating to the Product the user intends to replace (and the consequent cancellation of the relative order, with corresponding repayment of the Total Due Amount according to the provisions of art. 5.4 above), and, therefore, to the provision of a new order, concerning the product requested by the user to replace the one purchased. For what is not further specified by this paragraph and for substitutions concerning a Product of equivalent or lower value than initially chosen by the user, even if paid with Real Time Banking Mode, the provisions will be referred to in the art. 8.3.

This art. 8.3 does not apply to customized products, for which, since these are personalized products, the right to replace them is excluded.

9. Payment methods

9.1 The payment for the Products purchased on the Shop can be made by:

  • Bank transfer

  • PayPal payment solution

If one or more of the payment methods listed above cannot be used, and possibly also in relation to a specific Product or type of Product, this will be indicated on the Shop, at the beginning of the purchase procedure or, at the latest, before the user completes the purchase and transmits the order. In any case, the method of payment not available cannot be selected by the user during the purchase process.

Furthermore, if the user fails to complete the payment through one of the methods listed above, MORPHICA reserves the right to accept payments made by European bank transfer, with the procedure set forth in art. 9.3 and subsequent sub-paragraphs.

In the event of the user's request of replacement of a product, as regulated by art. 8.3 above, MORPHICA will proceed with the re-credit and debit transactions described in art. 8.3, par. (i) and (ii) above.

9.2 If the user fails to complete the order payment through one of the methods referred to in art. 9.1 above (for example, the negative outcome of the procedure for verifying the validity of the card and / or the absence of blockages; missing requested cash amount on the bank account; achievement of the expenditure ceiling, etc.) and if MORPHICA decides not to proceed with the termination of the contract pursuant to and for the purposes of art. 1456 of the Codice Civile, the order placed by the user will be suspended and the Customer Service will contact the user to propose payment by European bank transfer.

9.3 If the user agrees to pay by bank transfer, the Customer Service will send the user an e-mail containing the bank details necessary for making the transfer.

9.3.1 The payment of the Products by bank transfer must take place no later than 5 working days from the date of receipt of the e-mail referred to in art. 9.3.1. Once this period has expired, the contract will be terminated by law pursuant to and for the purposes of art. 1456 of the Codice Civile. The termination of the contract, of which the user will be notified by e-mail, will result in the cancellation of the order and the refund of the Total Due Amount, eventually paid late. As far as compatible, the art. 5.4 above will be applied.

9.3.2 In the case of payment by bank transfer, the delivery time of the Product will start from the date of receipt of the transfer by MORPHICA or from the date of receipt by MORPHICA of the receiving of successful transfer, depending on which of the two intervene first. To facilitate the connection between the payment received by bank transfer and the order, the user is asked to indicate in the purpose of the bank transfer:

  • The order number;

  • The date of transmission of the order;

  • The name and surname of the order holder, if different from those of the bank account holder from whom the transfer originates.

9.4 Payment. The Total Due Amount will be debited, at the same time as the conclusion of the contract through the Shop, to the bank account selected by the user. Unless otherwise agreed with the user, in the event of termination of the purchase contract and in any other case of refund, for any reason, the refund amount due to the user will be credited to the payment account thereof. The credit times depend exclusively on the company that provides the service and / or the banking system. Once the credit order has been arranged, therefore, MORPHICA cannot be held responsible for any delays or omissions in crediting the amount of the refund, to dispute which the user must directly contact the service providing company.

9.5 In the case of payment by PayPal, the user will be redirected to the www.paypal.com website where the user will pay for the Products with the procedure established and regulated by PayPal and the terms and conditions of the contract agreed between the user and PayPal. The data entered on the PayPal website will be processed directly by PayPal and will not be transmitted or shared with MORPHICA. MORPHICA is therefore not able to know and does not memorize in any way the data of the credit card connected to the user's PayPal account or the data of any other payment instrument connected with that bank account.

9.6 In the case of payment by PayPal, the Total Due Amount will be charged by PayPal to the user at the same time as the conclusion of the online contract. In the event of termination of the purchase contract and in any other case of refund, for any reason, the refund due amount to the user ("Refund Amount") will be credited to the PayPal account of the user. The credit times on the payment instrument connected to this account depend exclusively on PayPal and the banking system. Once the credit order has been placed in favour of this account, MORPHICA cannot be held responsible for any delays or omissions in crediting the user with the Refund Amount, to dispute which the user must contact PayPal directly.

9.7 In order to guarantee the safety of payments made on the Shop and prevent any fraud, MORPHICA reserves the right to ask the user via e-mail to send, a front / back copy of his / her currently valid identity card and, if the holder of the order is different from the holder of the credit card or the PayPal account, the identity card of the latter; it is also possible that MORPHICA requests, as an alternative or in addition to the foregoing, the authorization code relating to the transaction of the order given by the user. The deadline by which the document must arrive to MORPHICA will be specified in the request e-mail. This term will not, in any case, exceed 5 working days starting from the receipt of the request by the user. The order will be suspended until the requested information and / or document is received. The user is obliged to send the information and / or documents requested within the indicated term. If MORPHICA does not receive this information and / or documents within the period specified in the request e-mail or if MORPHICA receives incorrect or incomplete information and / or expired or invalid documents, the contract will be considered terminated by law pursuant to and for the effects. of art. 1456 of the Codice Civile and the order consequently cancelled, without prejudice to the MORPHICA's right to compensation for any damage that it may incur due to the user's non-compliant behaviour. The termination of the contract, of which the user will be notified by e-mail, no later than 5 days from the deadline for sending the information and / or documents requested by MORPHICA, will result in the cancellation of the order and the refund of the Total Due Amount possibly already paid by the user, with the application of the refund procedures provided for by art. 5.4, as far as compatible. If MORPHICA receives information and / or documentation valid within the indicated term, the delivery terms applicable to the Product will start from the date of receipt thereof.

9.8 In any case, the commercial invoice will be issued at the time of actual receiving of the payment and will be sent by e-mail to the user, to the address that the user has registered (except for the regulations envisaged for electronic invoicing for Italian customers).

10. Product Delivery

10.1 The delivery of the Products purchased on the Shop is carried out in all the States indicated in the art. 1.7 above, to the shipping address indicated by the user in the order form.

10.2 The user is therefore obliged to enter a shipping address on the order form.

10.3 The shipping costs of the Products in case of withdrawal and / or return, due to reasons other than the seller's and / or manufacturer's responsibility, which may vary according to the shipping method chosen by the user, and any other possible additional cost are the responsibility of the user, unless otherwise indicated in the Product Sheet or in other parts where it is communicated. Their amount will be expressly and separately indicated (in euros and excluding VAT) in the order summary, before the user proceeds with the transmission thereof and in the order confirmation e-mail.

If it is necessary to proceed with the reimbursement of delivery costs with reference to the case of withdrawal from a Multiple Order pursuant to art. 11 below, MORPHICA will refund the cost of these expenses only if the user intends to withdraw from the entire Multiple Order; in this case, the cost will be refund in full. Otherwise, the refund will not take place, in consideration of the fact that the delivery costs incurred by the user are attributable to the delivery of the other Products, other than those for which the user has exercised the withdrawal, forming part of the Multiple Order.

If instead the refund of delivery costs is the result of the unavailability of one of the Products belonging to the Multiple Order, as provided by articles 5.5 and 5.6, or of one of the cases of default by MORPHICA pursuant to art. 10.13, MORPHICA will refund the delivery costs to the user as follows:

The amount of delivery costs to be reimbursed cannot under any circumstances exceed the amount of the costs actually paid by the user for delivery. The user's choice between the options indicated in art. 10.4 (i) or in art. 10.4 (ii) must be promptly communicated to MORPHICA by e-mail to the address indicated in art. 16 below. If the user has opted for crediting the amount referred to in art. 10.4 (i) or in art. 10.4 (ii), it will take place in the way set forth in art. 10.16.

10.4 For shipments to Italy, delivery times are those specified at the time of payment. They run from the sending of the order, without prejudice to the provisions of art. 9.3.3. In the case of omitted indication of a delivery term, it will take place, in any case, within 30 days from the date of conclusion of the contract. The delivery terms are calculated considering only the working days and thus excluding Saturdays, Sundays and holidays.

10.5 At the time of shipment, that is the delivery of the Products to the courier service, an e-mail confirming the shipment will be sent to the user, containing a link that will allow to follow the progress of the shipment.

10.6 Deliveries in "standard shipping" mode will be made by the courier service, in any case, from Monday to Friday during normal business hours, excluding national holidays. MORPHICA reserves the right to choose courier services and / or to use different delivery methods. In this case the change will be indicated in the Product Sheet or with other dedicated communication.

10.7 The delivery obligation is fulfilled by transferring the material availability or in any case of check made to the user site.

10.8 It is up to the user to verify the conditions of the Product that was delivered to thereof. Notwithstanding that the risk of loss or damage of the Products, for reasons not attributable to MORPHICA, is transferred to the user when the user, or a third party designated by the user and different from the courier service materially takes possession of the Products, it is recommended to user to verify the integrity of the packaging and the number of Products received and is invited, where possible, to indicate any anomalies on the courier service's transport document. If the package shows obvious signs of tampering or alteration, the user is advised to immediately notify Customer Service. The application of the rules concerning the right of withdrawal and the legal guarantee of conformity remains unaffected.

10.9 The user acknowledges that the withdrawal of the Product is a specific obligation deriving from the purchase contract. In case of non-delivery due to the absence of the recipient at the address specified in the order form, the courier service will leave a notice of passage in the letter box containing the number to contact the courier service. The courier will then make a second delivery attempt. After two failed delivery attempts, the package will go "in stock". The Customer Service will then send an e-mail to the user in order to unlock the stock and ensure that the package is delivered to the user as soon as possible. If necessary, the Customer Service may agree with the user to change the shipping address. If this attempt also fails or the user does not respond to the attempt to contact Customer Service, the Product will be returned to MORPHICA and, in any case, after 30 working days from the first delivery attempt, the contract will be terminated and the purchase order consequently cancelled pursuant to art. 1456 of the Codice Civile. MORPHICA will then proceed, within 15 working days following the termination of the contract, to refund the Total Due Amount paid by the user, minus the costs of the delivery of the Product that failed, the return costs to MORPHICA and any other expenses incurred as a result of failure to deliver due to the absence of the recipient. The termination of the contract and the refund amount will be communicated to the user via e-mail. The refund will be credited to the same payment method used by the user for the purchase. If the user has made the payment by bank transfer, MORPHICA will ask the user for the bank details necessary to make the refund. Any delay in crediting may depend on the bank, the type of credit card or the payment solution used. In any case, the value date of the credited amount will be the same as the debit date.

In the event that, before the expiry of the 30 day period, the user requests to receive the Product again, MORPHICA will proceed with the new delivery prior charge, in addition to the expenses thereof, the costs of returning the Product to MORPHICA and the costs of custody.

10.10Those who have not collected the package more than twice cannot make purchases in the Shop. In the event that these parties place orders in breach of this provision, the purchase contract may be considered terminated by law pursuant to and for the purposes of art. 1456 Codice Civile. The termination of the contract will be communicated to the user via e-mail and the user will be returned the Total Due Amount in the manner and terms of art. 10.10 above.

10.11 In the event that the Product purchased is not delivered or is delivered late with respect to the delivery terms indicated in the order confirmation, the user, pursuant to art. 61 of the Codice del Consumo, invites MORPHICA to make the delivery within an additional period appropriate to the circumstances ("Termine Supplementare pursuant to art. 61, III comma, Codice del Consumo "). If this additional term expires without the Products being delivered, the user is entitled to terminate the contract ("Risoluzione del Contratto pursuant to art. 61, III comma "), without prejudice to the right to compensation for damages.

The user is not burdened with the burden of granting MORPHICA the Termine Supplementare pursuant to art. 61, III comma, Codice del Consumo ("Excluded Cases") if:

a) MORPHICA has expressly refused to deliver the Products;

b) The compliance with the delivery term indicated during the purchase process and in the order confirmation must be considered essential, taking into account all the circumstances that accompanied the conclusion of the contract;

c) The user has informed MORPHICA, before the conclusion of the contract, that delivery by or on a specific date is essential.

In the Excluded Cases, if the user does not receive the Products within the delivery term indicated during the purchase process and in the order confirmation, is entitled to immediately terminate the contract, except for the right to compensation for damages ("Termination of the Contract in Excluded Cases ").

The indication of the Termine Supplementare pursuant to art. 61, III comma, Codice del Consumo and the communication of Risoluzione del Contratto pursuant to art. 61, III comma, Codice del Consumo or Termination of the Contract in Excluded Cases shall be communicated by the user to MORPHICA at the addresses indicated in art. 16 below.

In the case of Risoluzione del Contratto pursuant to art. 61, III comma, Codice del Consumo or Resolution in Excluded Cases, MORPHICA will reimburse the User the Total Due Amount without undue delay. The refund will take place in the manner set forth in art. 10.16 below.

In the event that the user does not proceed with setting the Termine Supplementare pursuant to art. 61, III comma, Codice del Consumo or, if the requirements are met, the Risoluzione del Contratto pursuant to art. 61, III comma, Codice del Consumo or the Termination of the Contract in Excluded Cases, without prejudice to the possibility for the user to use at any time these remedies and / or the legal means provided by the law and, in particular, by the Capo XIV of the Titolo II of the Libro IV of the Codice Civile, MORPHICA undertakes to:

i. notify the user promptly and by e-mail of the delay in delivery ("Delay Notice E-mail"), indicating the new delivery time, if available ("New Delivery Time");

ii. in the case of delivery with a range time delay between 1 and 3 working days on the New Delivery Term, refund the delivery costs to the user, if already paid, within 10 working days from the expiration of the New Delivery Time or not requesting the payment, if not yet paid;

iii. in case of delivery with a range time delay between 4 and 10 working days on the New Delivery Term, allow the user who requests it to refuse delivery and terminate the contract, with consequent repayment of the Total Amount, if already paid, immediately and, in any case, within 10 working days from the request to terminate the contract or, alternatively, if the user does not want to terminate the contract, refund the user for the delivery costs, if already paid, within the term of 10 working days from the request or not requesting payment, if not yet paid;

iv. in case of late delivery of more than 10 working days on the New Delivery Time or, in any case, after 20 days the original delivery time, offer the user, in addition to the provisions of art. 10.12 (iii) above, the supply of a different Product of equivalent or higher value, upon payment, in the latter case, of the difference and upon the user's express consent. It should be noted that, if the user has chosen to pay the initial purchase with Real Time Banking Mode (where available), and, in the here regulated hypothesis, has chosen to obtain the supply of a product of a value greater than that of the Product delivered with delay, it will be necessary to proceed with the termination of the contract (and the consequent cancellation of the initial order, with corresponding repayment of the Total Due Amount according to the provisions of article 5.4 above), and, therefore, to the provision of a new order concerning the greater value product.

10.12 In the case of Multiple Orders with Products that must be delivered separately, the provision of art. 10.12 above will find independent application for each delivery. With respect to each delivery and therefore, limited to the Products covered by the same delivery, the user may proceed with the establishment of the Termine Supplementare pursuant to art. 61, III comma, Codice del Consumo and Risoluzione del Contratto pursuant to art. 61, III comma, Codice del Consumo or Termination of the Contract in Excluded Cases, with the related requirements. In this case, MORPHICA will refund the Partial Due Amount to the user without undue delay. The refund will take place in the manner set forth in art. 10.16 below.

In the event that the user does not proceed with setting the Supplementare pursuant to art. 61, III comma, Codice del Consumo or, if the requirements are met, the Risoluzione del Contratto pursuant to art. 61, III comma, Codice del Consumo or to the Termination of the Contract in Excluded Cases, in relation to the single delivery and the relative Products, without prejudice to the possibility for the user to use at any time these protection remedies and / or the legal means provided by the law and, in particular, from Capo XIV of the Titolo II of the Libro IV of the Codice Civile, MORPHICA undertakes to:

i. promptly send the Delay Notice E-mail to the user, indicating at the same time the New Delivery Time, if available;

ii. in case of delivery of one of the Products covered by the Multiple Order with a range time delay between 1 and 3 working days on the New Delivery Time, refund the delivery costs calculated as indicated in the art. 10.4 above if already paid, within 10 working days of the expiration of the New Delivery Term or not requesting payment if not yet paid;

iii. in case of delivery of one of the Products covered by the Multiple Order with a range time delay between 4 and 10 working days on the New Delivery Time, allow the user who requests it to refuse delivery and partially terminate the contract only and with exclusive reference to the Product subject to the Multiple Order delivered late, with consequent repayment - immediately and, in any case, within 10 working days from the request for partial termination of the contract - only of the amount paid by the user in relation to this specific Product , including delivery costs, calculated as indicated in the art. 10.4 above, or, alternatively, if the user does not want to partially terminate the contract, refund the user - within 10 working days from the request - delivery costs calculated as indicated in art. 10.4 above if already paid, or not requesting payment if not yet paid. The resolution of the entire Multiple Order will be possible only in the case of evident and proven accessorial of the Product (s) included in the Multiple Order delivered late or not delivered compared to the other Products of the Multiple Order delivered promptly or to be delivered;

iv. in case of delay in the delivery of one of the Products subject to the Multiple Order more than 10 working days on to the New Delivery Time or, in any case, 20 days after the original delivery time, offer the user, in addition to the provisions of art. 10.13 (iii) above, the supply of a different Product of equivalent or higher value, upon payment, in the latter case, of the difference and upon the user's express consent. It should be noted that, if the user has chosen to pay the initial purchase with Real Time Banking Mode (where available), and, in the here regulated hypothesis, has chosen to obtain the supply of a product of a value greater than that of the Product delivered with delay, it will be necessary to proceed to the partial termination of the contract (and the consequent partial cancellation of the initial order, with corresponding repayment of the Partial Due Amount according to the provisions of article 5.6 above), and, therefore, to the disposition of a new order, concerning the product of gretaer value.

10.13 In the event of failure to send the Delay Notice E-mail or failure to fix in the same e-mail the New Delivery Time, all the terms referred to in Articles. 10.12 (ii), (iii) and (iv) and 10.13 (ii), (iii) and (iv) above will run from the original delivery date.

10.14 Acceptance of the New Delivery Term and the user's choice in the cases referred to in Articles 10.12 (iii) and (iv) and 10.13 (iii) and (iv) must be promptly communicated to ITALIANTOUCH by e-mail to the address indicated in art. 16 below.

10.15 In all cases referred to in Articles 10.12 and 10.13 above in which a refund is due to the user, the refund amount will be communicated to the user by e-mail. It will be credited to the same payment method used by the user for the purchase. In the case of payment by bank transfer, MORPHICA will ask the user for the bank details necessary for the repayment. Any delays may depend on the bank, the type of credit card used or the payment solution used. In any case, the value date of the credited amount will be the same as the debit date.

11. Right of withdrawal

11.1 The user who is a consumer has the right to withdraw from the Product purchase contract, without having to provide any reasons and without having to incur costs other than those set forth in art. 11.7 below, within 14 calendar days. The withdrawal period ("Withdrawal Period") expires after 14 days:

a) in the case of an order relating to only one Product, from the day on which the user or a third party other than the courier service and designated by the user materially takes possession of the Products;

b) in the case of a Multiple Order with separate deliveries, from the day on which the user or a third party other than the courier service and designated by the user materially takes possession of the last Product; or

c) in the case of an order relating to the delivery of a Product consisting of multiple lots or pieces, from the day on which the user or a third party other than the courier service and designated by the user materially takes possession of the last lot or piece.

11.2 To exercise the right of withdrawal, the user must inform MORPHICA, before the expiry of the Withdrawal Period, of the decision to withdraw.

11.3 For this purpose, the user can:

a) use the standard withdrawal form made available in the Shop, before the conclusion of the contract ("Standard Withdrawal Form") and attached to the order confirmation e-mail; or

b) submit any other explicit statement of the decision to withdraw from the contract ("Declaration of Withdrawal").

11.4 The user has exercised his right of withdrawal within the Withdrawal Period, if the communication concerning the exercise of the right of withdrawal is sent before the expiry of the Withdrawal Period. If the user makes use of the Declaration of Withdrawal, the consumer is invited to indicate in the Declaration of Withdrawal the order number, the Product (s) for which the user intends to exercise the right of withdrawal and the user address. Given that the burden of proof relating to the exercise of the right of withdrawal before the expiration of the Withdrawal Period is borne by the user, it is in the interests of the user to avail of a durable support when he / she communicates the withdrawal to MORPHICA.

11.5 The user must therefore arrange to return the Products to MORPHICA, without undue delay and in any case within the period of 14 calendar days from the date of the communication to MORPHICA about the decision to withdraw. The deadline is met, if the user returns the Products before the 14 days period expires. For the return, the user must follow the procedure indicated in the art. 11.6 below, as well as in the standard instructions on withdrawal, which also contain information on the exercise of the right of withdrawal, and are made available to the user both on the Shop, before the conclusion of the contract, and as an attachment to the e-mail order confirmation.

11.6 In the condition indicated in art. 11.5 above, the user who returns the Product from the same country in which the Product was delivered must return it, appropriately protected and packaged, through the courier service with whom it received the order, and the pre-printed and prepaid label provided to the user together with the Product should be attached on the Product packaging to return. The user, in order to arrange on the date and place of collection of the package, can contact the courier service, whose contact details are indicated in the standard withdrawal instructions. In this case, the user will not pay the costs of returning the Product, which will be borne by MORPHICA, and will not bear the risk of loss or damage to the Product during shipment.

The procedure described above is available only if the user returns the product from the same country in which the product was delivered, as shown in the order confirmation e-mail (eg: if the user who purchased the X product asked for the product to be delivered to him / her in Italy, the prepaid return procedure referred to in this paragraph may be used only if the place of collection of the Product object of withdrawal is in Italy). Otherwise, if the user wishes to return the Product from a country other than the one (indicated in the order confirmation email) in which the delivery took place, the return of the Product to MORPHICA must be made, without undue delay and in any case within 14 calendar days from the date on which the user communicated to MORPHICA his / her decision to withdraw, using a courier service chosen by the user and at the expense of the user. The deadline is respected, if the user returns the Product before the expiry of the 14 days period mentioned above. The Product, properly protected and packed, must be sent to the following address:

In the just foreseen hypothesis, the direct costs of the return (including possible customs costs) of the Product to MORPHICA are the responsibility of the user and the return of the Product to MORPHICA takes place under the responsibility of the latter. In the case of Products which by their nature cannot normally be returned by post, the estimated cost for the return of these Products will be indicated in the standard instructions on withdrawal pursuant to art. 11.5 above. In any case, for the purposes of the expiry of the repayment term referred to in Article 11.5 above, the Product is considered returned when it is delivered, within the aforementioned deadline, to the courier service indicated by MORPHICA, or, as the case may be, to the accepting post office / courier service chosen by the user.

11.6-bis As an alternative to the procedures for exercising the right of withdrawal and return of the Products pursuant to articles 11.4, 11.5 and 11.6 above, the user who returns the Product from the same country in which the Product was delivered can:

a) after having exercised the withdrawal within the Withdrawal Period, in the manner indicated in the articles 11.3 and 11.4 above (using and handing over the Model Withdrawal Form or the Declaration of Withdrawal or by completing the first and / or performing the second one at) MORPHICA), personally return the Product to the registered office of MORPHICA - Monopoli (BA) - 70043 Via Eugenio Montale n. 3) within the Term for Restitution;

The user who wishes to exercise the right of withdrawal and / or return of the Product at the registered office of MORPHICA is requested to bring and present to this office: (i) the purchase invoice contained in the confirming e-mail of the Product shipment; (ii) the completed Withdrawal Form; and (iii) the courier Label and invoice received at the end of the order.

11.6-ter With reference to the exercise of the right of withdrawal from the Authorized MORPHICA Affiliate or the registered office of MORPHICA and the return to the Authorized MORPHICA Affiliate or the registered office MORPHICA for which the user has already exercised or intends to exercise the right of withdrawal, according to the provisions of art. 11.6-bis above, we specify the following:

i. in the event that the user wishes to exercise the right of withdrawal from the Authorized MORPHICA Affiliate or the registered office of MORPHICA and has not already filled in and signed the Withdrawal Form, the employee of the Authorized MORPHICA Affiliate or the registered office of MORPHICA ("Sale Assistant") will print the Withdrawal Form and ask the user to complete it and sign it;

ii. the exercise of the withdrawal and / or the return of the Product in the manner set forth in art. 11.6-bis above, are permitted only with Authorized MORPHICA Affiliate or the registered office of MORPHICA; shops / offices / laboratories other than Authorized MORPHICA Affiliate or the registered office of MORPHICA are not authorized to accept the return;

iii. are also fully applied in the case of exercise of the right of withdrawal and / or return of the Product to the Authorized MORPHICA Affiliate or the registered office of MORPHICA the provisions of the articles 11.7, 11.8, 11.9, 11.10 and 11.11 which follow; the result is that, if the withdrawal has been exercised in accordance with the provisions of the applicable legislation, MORPHICA will proceed with the refund of the Total Due Amount, calculated as indicated in the art. 11.7 below and in the timescale in this article, using the same payment method used by the user for the initial transaction, unless the user has expressly otherwise agreed. In any case, cash reimbursement is excluded;

iv. in the case of return of the Product to the Authorized MORPHICA Affiliate, the costs of returning the Product from this affiliate to MORPHICA are borne by MORPHICA which also assumes responsibility for transporting the Product;

v. The Authorized MORPHICA Affiliate will provide the user with a copy of the Withdrawal Form as a receipt for the acceptance of the Product, from which the exercise date of the right of withdrawal and / or, depending on the case, product returning, will result.

11.9 If the user withdraws from the contract, MORPHICA will refund the Total Due Amount paid by the user for the Product, not including delivery costs, without undue delay and in any case no later than 14 calendar days from the day on which MORPHICA was informed of the user's decision to withdraw from the contract. The refund amount will be communicated via e-mail; the refund will be made using the same payment method used by the user for the initial transaction (in the case of payment by bank transfer, MORPHICA will ask the user for the bank details necessary to make the refund), unless the user has expressly otherwise agreed; in any case, the user will not incur any fees as a result of this reimbursement. The credit value date will be the same as the debit date. In the case of partial withdrawal from Multiple Orders, MORPHICA will not refund delivery costs, in consideration of the fact that the delivery costs incurred by the user (which are calculated in a fixed amount, regardless of the number of Products ordered) are attributable to the delivery of other Products, other than those for which the user has exercised the withdrawal and which are part of the same Multiple Order. If the user returns the Products subject to withdrawal from a country other than the one (indicated in the order confirmation email) in which the delivery took place, and, therefore, using a courier service of his / her choice and at his /her own expense , MORPHICA may suspend the refund until receiving the Products or if previous, the demonstration by the user of having sent back the Products.

11.10 The user is responsible only for the decrease in the value of the goods resulting from the handling of the Product other than that necessary to establish the nature, characteristics and functioning of the Product. The Product must in any case be kept, handled and inspected with normal diligence and returned intact, complete in all its parts, fully functional, complete with all accessories and illustrative sheets, with identification tags and labels, where present, still attached to the Product is intact and not tampered with, as well as perfectly suitable for the use for which it is intended and free from signs of wear or dirt. The withdrawal also applies to the Product in its entirety. It cannot therefore be exercised in relation to parts and / or accessories of the Product.

11.11 If the withdrawal has not been exercised in accordance with the provisions of the applicable law, it will not lead to the termination of the contract and, consequently, will not entitle to any refund. MORPHICA will notify the user within 5 working days of receiving the Product, rejecting the withdrawal request. The Product, if already received by MORPHICA, will remain at the latter available to the user for collection, which must take place at the expense and under the responsibility of the user.

11.12 In the event that the Product for which the withdrawal was exercised has suffered a decrease in value resulting from the handling of the goods other than that necessary to establish the nature, characteristics and functioning of the Product, the refund amount will be reduced by an amount equal to this decrease in value. MORPHICA will notify the user of the fact and of the consequent decreased refund amount within 5 working days from receipt of the Product, providing the same user, in the event that the refund has already been paid, the bank details for the payment of the amount due from the user due to the decrease in value of the Product.

11.13 In the event that, occurring one of the legal hypotheses, the right of withdrawal is not applicable, this exclusion will be specifically and expressly communicated in the Product Sheet and, in any case, during the purchase process, before the user proceed with the transmission of the order. The user is reminded in any case that, pursuant to art. 59 of the Codice del Consumo, the right of withdrawal is excluded, among other things, in the case in which the sale relates to Products for which a customization has been requested (personalization), as these products are made to measure and / or clearly customized by the user. The right of withdrawal, in any case, is not applicable to customized products.

12. Legal guarantee of conformity

12.1 All products sold on the Shop are covered by the Garanzia Legale di Conformità provided for in Articles. 12-13 of the Decreto Legislativo n. 206/2005 ("Codice del Consumo") ("Legal Guarantee ").

12.2 TO WHOM IT APPLIES

The Legal Guarantee is reserved for consumers. It therefore applies only to users who have made the purchase on the Shop for purposes unrelated to their entrepreneurial, commercial, craft or professional activity.

12.3 WHEN APPLYING

The seller (and, therefore, with regard to purchases made on the Shop, MORPHICA) is liable to the consumer for any lack of conformity existing at the time of delivery of the product and occuring within two years of this delivery. The lack of conformity must be reported to the seller, under penalty of forfeiture of the guarantee, within two months from the date on which it was discovered.

Unless otherwise proven, it is assumed that the lack of conformity that occurs within 6 months of the product delivery already existed on that date, unless this hypothesis is incompatible with the nature of the product or with the nature of the lack of conformity. Starting from the seventh month following the delivery of the product, it will instead be the responsibility of the consumer to prove that the lack of conformity already existed at the time of delivery.

In order to take advantage of the Legal Guarantee, the user must therefore first provide proof of the date of purchase and delivery of the goods. Therefore, for the purposes of this test, the user should keep the purchase invoice sent by MORPHICA.

12.4 WHAT IS THE DEFECT OF CONFORMITY

There is a lack of conformity when the purchased good:

i. it is not suitable for the use for which goods of the same type are normally used;

ii. it does not conform to the description given by the seller and does not possess the qualities of the goods that the seller has presented to the consumer as a sample or model;

iii. it does not have the usual qualities and performances of a good of the same type, which the consumer can reasonably expect;

iv. it is not suitable for the particular use desired by the consumer and that has been brought to the attention of the seller by the time the contract is concluded and that the seller has accepted.

Any faults or malfunctions caused by accidental facts or by the user's responsibility or by use of the product that is not in conformity with its intended use and / or as provided in the technical documentation attached to the product are therefore excluded from the scope of the Legal Guarantee.

12.5 REMEDY FOR THE USER

In the event of a lack of conformity duly reported, the user is entitled for:

i. primarily, the free repair or the replacement of the product, of his / her choise, unless the requested remedy is objectively impossible or excessively expensive compared to the other;

ii. in secondary way (in the case that the repair or the replacement are impossible or excessively onerous or the reparation or the replacement have not been realized within suitable terms or the reparation or the replacement previously made have caused notable inconveniences to the consumer) of his / her choice the price reduction or the termination of the contract.

The requested remedy is excessively onerous if it imposes unreasonable costs on the seller in comparison to the alternative remedies that can be experienced, taking into account (i) the value that the goods would have if there were no lack of conformity; (ii) the significance of the lack of conformity; (iii) the possibility that the alternative remedy may be performed without significant inconvenience to the consumer.

12.6 WHAT TO DO IN THE PRESENCE OF A DEFECT OF CONFORMITY

In the event that a product purchased on the Shop, during the period of validity of the Legal Guarantee, manifests what could be a lack of conformity, the user can contact Customer Service, at the addresses indicated in art. 16. The Customer Service will promptly reply to the communication, indicating to the user what next steps should be taken.

The Product which is related the lack of conformity user complains must be sent to the following address to MORPHICA, which will carry out the verification of the existence of the underlined defect.

MORPHICA reserves the right to ask the user to attach to the request the purchase invoice and / or DDT or other document proving the date of the purchase and the delivery date.

13. Conventional Guarantee of Manufacturer

13.1 Products sold on the Shop may, depending on their nature, be covered by a conventional warranty provided by the manufacturer ("Conventional Guarantee"). The user can assert this guarantee only against the manufacturer. The duration, the extension, even territorial, the conditions and methods of use, the types of damage / defects covered and any limitations of the Conventional Warranty depend on the individual manufacturer and are indicated in the so-called warranty certificate contained in the product packaging.

The Conventional Guarantee is voluntary and does not add, does not replace, does not limit and does not prejudice or exclude the Legal Guarantee.

14. Flash Sales and Prize Competitions

14.1 MORPHICA may organize Event Sales or Flash Sales. These sales will have a predetermined and limited duration, which will be clearly indicated on the Shop, and may be reserved for certain categories of users registered on the Site who could be notified of the start of the sale by a special invitation e-mail.

14.2 MORPHICA may organize competitions and prize operations reserved for users registered on the Site. The Rules of each competition or prize operation will be available in the appropriate section of the Site or the Shop. In the event that the prizes consist of discount vouchers or equivalent forms, they may in no case be converted into cash.

15. Applicable law; Out of court settlement of disputes - Alternative Dispute Resolution / Online Dispute Resolution

15.1 The purchase contract concluded on the Shop is governed by Italian law.

15.2 The application is reserved to users who do not have their habitual residence in Italy of more favourable and mandatory provisions provided for by the law of the country in which they have their habitual residence, in particular in relation to the term for the exercise of the right of withdrawal, to the term for the return of the Products, in case of exercise of this right, to the manners and formalities of the communication of the same and to the legal guarantee of conformity.

15.3 For any dispute relating to the application, execution and interpretation of these General Sales Conditions, the jurisdiction of the place where the user resides or has elected domicile is competent.

15.4 According to the art. 141-sexies, comma 3 of the Decreto Legislativo 6 settembre 2005, n. 206 (Codice del Consumo), MORPHICA informs the user who is a consumer pursuant to art. 3, paragraph 1, lett. a) of the Codice del Consumo, that, if he / she has submitted a complaint directly to MORPHICA, which dispute thus arisen has not been possible, however, to resolve, MORPHICA will provide information regarding the body or bodies of Alternative Dispute Resolution for the out-of-court settlement of disputes relating to obligations arising from a contract concluded on the basis of these General Sales Conditions (so-called ADR bodies, as indicated in articles 141-bis and ss. Codice del Consumo), specifying whether it intends to make use of these bodies to resolve the dispute. MORPHICA also informs the user who is a consumer pursuant to art. 3, comma 1, lett. a) of the Codice del Consumo, that a European platform for the online resolution of consumer disputes is established (so called ODR platform). The ODR platform can be consulted at the following address http://ec.europa.eu/consumers/odr/; through the ODR platform the consumer user can consult the list of ADR entities, find the link to the site of each of them and start an online resolution procedure for the dispute in which they are involved. In any case, these two aspects remain unchanged for the consumer user: - the right to refer the dispute deriving from these General Sales Conditions to the competent ordinary judge, whatever the outcome of the procedure for out-of-court settlement is; - if the conditions exist the possibility of promoting an out-of-court resolution of disputes relating to consumer relations by resorting to the procedures set forth in Parte V, Titolo II-bis of the Codice del Consumo. The user who resides in a member state of the European Union other than Italy, can also access, for any dispute relating to the application, execution and interpretation of these General Conditions of Sale, to the European procedure established for the disputes of modest entity, by Regulation (EC) n. 861/2007 of the Council, of 11 July 2007, on condition that the value of the dispute does not exceed, excluding interest, rights and expenses, Euro 2,000.00.
